State of DataVeillance in the U.S., 20+ Years in a State of Denial.

This is the Summer of 2009.  In Europe protests over dataveillance and visual surveillance are continuing.  The U.S. is rife with debate that continues to avoid the dataveillance implications of electronic medical records. The EU's Article 29 Data Protection Working Party is having a Public Consultation with a December 2009 deadline. They are asking EU citizens to comment on the Fundamental Right to Protection of Personal Data. The United Nation's Guidelines for the regulation of computerized personal data was used as a basis for my Title VII Federal Court Action claiming Retaliation, even before the United Nations had passed the Resolution. This was also a U.N. document associated with the initial European Parliament's action in creating the Article 29 Working Group.

 Failure to recognize real long term implications of this concentration of data in the hands of governments on both fronts may change the world forever, and not for the better. There will be a failure if the capabilities of integrated technologies are not recognized and open debate is not initiated.

Despite continuing economic threats and other retaliations, I'm going to finish what I started writing in Geneva. I have an overwhelming amout of work this fall 2009 & may not complete this, "white paper".  As background you might read the About US page at this website or the court documents at Geocities until October when Geocities comes down.

A "normal" life isn't something I've ever understood. Since my childhood, I've always been aware of this technology around me and have been driven by it in ways others are not. In my teens while everyone was looking for boyfriends, I was reading Alvin Toffler, trying to understand Edgar Cayce and science, alone, despite hazing.  When I talk to people of my own age group and sometimes younger Americans it's like listening to insane people, After I filed the Complaint against the US Government at the U.N. Human Rights Commission in the summer of 1988, I met some translators for the European Parliament, one while I was hitchhiking. What are the odds? She called me the intellectual American. What does that mean? This is not the Fiction part of Film Studio Faux. I see the world through the eyes of someone who has never understood this lack of insight. The fiction I have to write is far wilder than even this. I write this as people around me would really prefer to believe that these facts are the fiction. They are not.
 
DataVeillance Tracking the Trackers:

1988 DATA TRANSFER EVENTS, without the use of electronic stored data, but with the use of communication satellites.
(Some, but not all of this data may have been electronically stored on private desktop, as keylogger programs like the FBI's Magic Lantern have been available for decades, and some others on government or other database)

EVENT #1 RCA Satellite at the ITU, International Telecommunications Union, Geneva, Switzerland.


Summer 1988, I was being forced from my home, because of the conflict with the New York Times that was partly described in the "About Us" page. I prefer to save the

details.  They are complex and confusing because of local politics and my role as a witness at a music concert that ended in homicide where I was attempting to start a documentary.

This Title VII lawsuit was backed up with thousands of documents. By "local" politics I mean, in the 80's in Central Florida more than one Sheriff was removed from office on allegations

of corruption and associations with the KKK, after investigation from the Press.


After years of research, it's apparent that the NY Times and other news agencies have their Attorney's use a "process", an organized method of deterrence, undermining legitimate

litigants, individuals with lawsuits against them for civil rights reasons, particularly employees. Part of that process is taking the "facts" as they want them known to the public and

provoking the public to ACT on those facts, which are often defamatory. They want their version of a case tried in public so no court will fairly review it.


In 1986, I was  threatened, by the newspaper, that I was going to be made "famous", "How would I like that?" That simply says to me, as an artist who is just beginning, that

the press are going to end my career.  In 1988, with a last minute instinct I  bought a standby flight to Europe, going to the  ITU, the International Telecommunications

Union, in Geneva, Switzerland.


I traveled there partly because of a letter from the FCC. It's been online for a decade. They replied to my inquiry. Writing, the type of technology I described in

an inquiry was possible, but that the FCC (U.S. Federal Communications Commission) didn't regulate the use of  satellites. These documents are under SEAL of that

agency.


In Europe, at Customs I knew that my data had been transferred electronically. The customs officer "looked exactly like" an Editor at the newspaper

whose name was on a police report. After I was asked "How I would like that?" to the statement they were going to make me famous, like Mary Ellen Mark, 

I answered,  I would like to kill somebody. I've had some law school training, I had recently been warned this was merely a process of defamation by the

newspapers.  I had been a very private person. I didn't even use back stage passes to rock concerts, that I had from the paper, unless I had an assignment. I worked

7 days a week and never went out socially.


Describing the "process" of being followed by dataveillance that isn't even talked about, let alone technically defined, is unreal. Although, they had no

problem believing it at the ITU or the Human Rights Commission in Geneva.


I went to the ITU, to research. My impression was they are nice people in one of the hardest positions in the world. They are between governments that are lying

about how they are using technology, evidenced by U.N. records, and their own knowledge of how technology is being used. The Librarian, I have to admit to a

luv for Librarians, set me up with a meeting with what I believe was an American who I told that the U.S. Congress was using interception devices. Eye to eye he told

me that he knew that this technology was available, but not that it was being used - yet.


I was a stranger to him. He told me he had to go out for a moment. He left me alone in his private office at the ITU sitting at a table with documents. I started to read those

papers. They had information on RCA's satellite systems. It wasn't a coincidence. In 1987, after a couple of years of not just threats that the NY Times (by their agents) could make things

happen and that they "taped", whatever that means, but of actual violence being carried out, I filed an EEOC complaint. My Equal Employment Opportunity Commission, complaint for

Retaliation against them for having threatened to file a complaint with them dated back to 1985. Most of these events of theft or violence, ended by meeting with police or

in the U.S., a Federal Police Officer, indicating I should stay away from the newspapers. In those instances I had NEVER mentioned a newspaper. This happened in Europe and the U.S.


In that complaint to the US agency, I let the EEOC know I was working 2 jobs. I had worked over 365 days without a day off. The 2nd job was as a Tourism Rep for a Major

Auto Rental Company in the State of Florida. They had been taken over by RCA, who also owned NBC at that time. RCA had taken some steps to change office

technology. Some co-workers indicated there could be surveillance.  I attempted to fairly depict all the players and how each had ties to news organizations.


The information I wrote about RCA in my EEOC complaint would not have been available to anyone but a US Government Agency and a New York Times Attorney.

That Attorney would have been copied by the EEOC a U.S. Government agency. This is one story about one piece of DATA that was known to travel from one country to another in 1988.

(Interesting aside, in 1990 RCA, a division of GE, was ordered to pay a fine for receiving secret Pentagon documents...This isn't Sci-Fi folks).


A photojournalism newsletter had a report of information leaking in another EEOC cases in 1985-1986.  One women who had filed an EEOC against a newspaper

reported her information also "leaked".  Yet another, had a job opportunity and was placed with a Photo Editor later to be charged with child abuse on the grounds of the paper.


In the summer of 1988 in Geneva, this was one of dozens of such events of personal Dataveillance, with integrated technologies. It was debilitating.


From the perspective of a victim, the eavesdropping technology being used by the US Congress for surveillance  encouraged  a form of traffiking and defamation.

It was the subject of a complaint I filed at the United Nations in the summer of 1988, with a representative at the U.N.,  Dougan Beaca,  at the Palais Human Rights office.

It was on a form from the Economic and Social Council,  Prevention of Discrimination against Women and Children,  the Human Rights Commission.

At least I believe that was the form. I named two then Senators in the Congress, Ted Kennedy and Al Gore, and one news agency, then Ted Turner's CNN.


The complaint was a poorly written mess as I was as mess.  I hit a mental low in Geneva when I found the research at the United Nations supporting widespread technology

abuse.  My U.N. complaint was written while a Japanese student, in Geneva with her brother, was practicing her Violin in a public room at the Hostel where I was staying.


   By the end of that summer I was living on the good will of the Swiss, in and out of the streets, but spending every other moment searching European libraries for

research that was not available in Florida.  A man who resembled Jon Voight took me home to dinner with his family and then drove me to Fribourg's train station

handing me $100 Swiss francs, unsolicited, and refusing to take it back.  I got a room, went to the Abbey in Fribourg and prayed for his family. The next

day at the University Library in Fribourg I found an ACM article by Roger Clarke on Dataveillance and witch hunts. Also, I found an article that led me to Chaos in Hamburg

right after thier famous hack at Nasa (Time Inc in Bonn gave me their address in Hamburg), and on to other Data surveillance information that helped me support my

theory of government abuse of dataveillance in a U.S. Federal Court. The N.Y. Times first threatened retaliation, then knew how to go about setting it up by providing false

reports to a Federal Government agency.  In Federal Court they admitted to providing false information to the IRS when asking for a change in an employment determination.


Before my 1988 trip to the United Naitons in Geneva, information was available to the U.S. Government about a potential lawsuit against the N.Y. Times through two different

government agencies: Internal Revenue Service (IRS) and the Equal Employment Opportunity Commission (EEOC). Yet the "leaked" private information about me that crossed

borders contained more than the information at those two agencies. 


Ted Kennedy, when William Kennedy Smith was accused of rape, was noted for telling a woman that she new nothing about, I believe, it was international politics.

Unlike her, I do. I grew up in Tourism, meeting men who would never allow their wives to travel alone.  I filed this when in most nations women had no recourse for civil rights

violations, particularly when they were being threatened with mental institutionalization, as I was.
 

Sexual harassment was alive and well at the United Nations in the 80's, I believe there was a court case.  Elsewhere in Geneva that summer, a Swiss girl, who had

helped me, let me know that her Boss at a Church organization had been replaced by an American. She said, he was a chauvinist pig. For changes in how sex discrimination

cases are handled at the United Nations see the new optional protocal to  CEDAW . as of yet unrecognized by many nations. Many of these nations are using technology to

accomplish the same end result as terrorist organizations, in suppressing women's rights.


 By 2009, unfortunately, the integration of technologies and the success of this technology convergence is preventing vigorous intellectual debate, particularly in the United States.

It's led to rising mediocrity across many fields. This is accompanied by complacency. Individuals not educated enough or not willing to risk any economic backlash (loss of financing)

to vigorously question what corporations were telling people and what the media was supporting by blindly reporting on what those corporations held out to be facts. This was the

impetus behind the economic downfall in the United States. And yes, the lack of access to health care in the U.S. has been used as a weapon of fear in this debate. It is

questionable now whether any change in the health care system would help, as proposed electronic nationalization of electronic health records can easily be used for the same

purpose, to promote fear amongst those who would otherwise speak out against corruption. This is not gender based. 


The ILO in the 90's began to publish reports of types of hazing appearing in the workplace that involves group bullying. This is particularly prevalent where education and

intellectual vigor is not encouraged as a daily part of the work environment. Instead, a seniority system evolves with those most willing to be tolerant of and complacent to

corporate and old boy cultures, that are inherently corrupt, rise in top management.  Despite the recent backlash against the banking, stock markets and auto markets in the

United States, this has not changed. Surveillance technologies are used to support and reward cronyism, nepotism, and cultural hazing.  This technology can be used both in

the workplace and directed at the worker in the home. Until this integration of technology is attacked as unconstitutional in the U.S. and other free nations,  corrupt corporate

cultures and government agencies will continue to be on the rise and not the decline, despite changes in government. 


A CALL FOR OPEN DEBATE:

In 1988, it was an evil process of using technology for data manipulation.  All the statements in documents at the United Nations were in agreement of potential for even greater abuse. 

A potential now realized.  Integrated technology will subvert the work of the Article 29 Working Group at the EU.  Even the most recent call for White Papers and some European online

data sites don't confront how these technologies are being integrated to subvert the legal systems in all countries.  I jokingly call this "BARS"  or "Barristers" of SOAP, Wash your own

Brain syndrome.  Guys, there's some great toilet paper at Staples in Germany ;<), where call for "white papers" result in publications with narrow aspects of technology dissected while

they never show the bigger picture. To do that one would have to start by looking at who is making the most money from this technology, the enablers.


Eutelsat, is reporting EUTELSAT COMMUNICATIONS REPORTS REVENUE GROWTH OF 7.2% AND NET INCOME INCREASE OF 43.6% FOR ITS 2008-2009 FINANCIAL YEAR.

In a worldwide recession this corporation is reporting growth.



September 12th has been labeled "Freedom not Fear" day by online activists:

Human rights activists who lobbied the ITU to include the Human Rights Commission in their agenda's were right but they themselves have not had the courage to write about the

integrated issues with particularity. Why? For one thing, the European Partliament's (EU's) failure to reach a conclusion and ACT on it after the Echelon investigation. It was reported

by one French Ambassador in a special committee report (I've lost the exact paper but it is one of these!) that upon his visit to the United States the govt. denied using listening devices. 


I gather the French are just making things up in their heads? Or is it just that if you can't beat them, you join them!


The questions that should be asked by activists is how much of this eavesdropping, or tracking and tracing,  technology is being used for corporate and government espionage, secret

collections, or even "hazing", as Christopher Weermantry International Judge/author/activists has written about using it for "needling", as opposed to child welfare, finding missing

children, preventing genocide or even preventing deaths of armed forces in hostile areas worldwide. I can testify that while major fraud was taking place by individuals in the investment

and banking areas my own daily finances and actions were under more severe scrutiny than any of the later to be found frauds.

Go Europe, back in the 80's had Cover Art of a hand thumbing,  hitchhiking. Being a child of the tourism industry that seemed normal to me. As I made my way around Europe in 1988, so did the media.

Six meetings that changed the summer of 1988.

This series of events is called illegal U.S. government collections abroad. DATA, DATA everywhere - no Star Trek in sight:

1) German Law Student Interning in Switzerland at an embassy, on her way to intern in Japan, allegedly. I remember her slightly: Tall lean,straight medium brown hair about to her shoulders, reserved Type B personality. I was living with her at a youth hostel in Geneva. She described what she thought to be the U.S. Government's selling of babies.

2) EU Translator Swiss/Italy Amnesty International Concert in Milan. She drove me to Milan. I'll always remember her calling me the intellectual American. 

3) Swedish Commuter Sweden/Norway He told me a story about Cows having their babies taken away from them as he drove me over the border. I was going to the Nobel Institute in Norway to make inquiries about science.

4) Truck driving couple on their way to Strausburg, then seat of the European Government, from Germany, set me up on a date with another truck driver, below, via their radio.

5) Trucker Germany who was ex-military and believed that some Germans made a deal with the U.S. Government to get American women pregnant. I had traveled with him a couple of times, met his family and agreed to go to Denmark with
him to see Robin Wiliams in Good Morning Vietnam. It wasn't playing.

6) Danish IA Denmark, home of "The Politiken"and Lars' Dog. IA intervened very quickly after I had to get myself arrested to avoid an attempted murder and rape, by the person who thought my government wanted me pregnant.  Internal Affairs didn't know me from jack. The first thing I was told was to stay away from the newspapers! As close as I had come to one was to look in the window of "The Politiken" at night at the graphics, a display of the Killing Fields. After a very interesting conversation, where an IA officer, who was also a member of Greenpeace, expressed his view that I must owe my government money. It was a quick flight home on SAS.

Whether the technology and data that followed me around that summer and fall of 1988 was an actual reflection of what my government wanted or of what people or the press interpreted as what was happening, it did not matter. The result was the same. It could have been expected to be the same. I had a brutal attempted homicide by someone who believed in some way they were carrying out a wish of my government. IA in Denmark did not do too much to prove that untrue.

There is no doubt that the complaint I filed at the United Nations with Dougan Beaca about the U.S. Congress had leaked
soon after I filed the complaint. These moments were not isolated, these were just the most significant for one reason or
another. 20 years later we have institutionalized surveillance that effects people in ways they cannot understand, because
over decades they've been conditioned not to discuss it. I can't even count how many times I've been told to shh!

Some years later The New York Times partnered with The Politiken, as many of their contracts with foreign newspapers they
reprint articles, special sections of the Times, or the Magazine section.

As of 2009, CNN has been reported by me to the U.S. Federal Communications Commission half a dozen times.

Lastly, the transmission of records included some of my medical records. Now that's the kicker. So believe as you will what
your government is telling you about their ability to protect your personal data, but I know if they can't even prove the existence and use of another government's satellite spy network, engaging programs like Magic Lantern (keylogging) and
eavesdropping technology,
they cannot protect your data.
